Chapter 6 - DEREK’S IDEA OF “FAMILY” HAD ALMOST MADE HIM HIS OWN DAUGHTER’S BROTHER

Allen Mitchell was still alive.
Seventy-two.
Living in Arizona.
Derek had not spoken to him in six years.
Yet Northstar records showed a preserved sample under Allen’s name.
Allen froze sperm at thirty-seven before lymphoma treatment.
The sample remained stored.
Who paid annual fees?
Derek.
For ten years.
Why?
He told me:
“Dad asked me to keep it.”
Allen denied.
“I forgot that sample existed.”
Then how did Derek gain control?
Allen had once listed Derek as medical-storage contact.
Not reproductive-use authorization.
Again boundaries.
Derek considered it “family genetic material.”
That phrase sounded too familiar.
Then why choose father as backup?
He wanted a child genetically connected to him.
If his father’s sperm created baby, child would be Derek’s genetic half-sibling but legally potentially his child depending assisted reproduction consent.
He rationalized:
“Still my blood.”
I stared at him during deposition.
“You would have let me believe your biological sibling was our daughter.”
He cried.
“Yes.”
That ended any remaining fantasy that he understood consent at the time.
Then:
“Why didn’t you use donor bank?”
“Because I didn’t want a stranger.”
“So you made everyone else strangers to the truth.”
He closed eyes.
Good line.
Then Northstar’s involvement.
Dr. Lane claimed Derek said I knew.
Of course.
He should have verified.
He did not.
Clinic settlement negotiations eventually included:
My altered consent.
Michael’s unauthorized redirection.
Allen’s unauthorized backup designation.
We preserved confidentiality for Emily’s privacy but not gagging truth.
Then state medical board investigated Dr. Lane.
Northstar replaced leadership.
Michael reclaimed/destroyed remaining sample except what he chose.
Allen did too.
Good.
Then Derek’s financial case.
He had to sell Buckeye stake to satisfy marital settlement and debt.
Vanessa bought under independent valuation.
He lost business partner.
Consulting LLC collapsed after clients left.
He found new job at lower salary.
The house?
Legally mostly his separate property because purchased before marriage, but marital mortgage payments and improvements created a marital component.
We negotiated.
I received fair share.
No fantasy of taking entire house.
He kept it.
Then one day he sent photo.
Fifteen dollars under glass frame.
The same bills?
He had kept them.
On kitchen counter after I left.
He wrote:
I deserve to remember what fifteen dollars cost me.
I did not respond.
Then parenting.
Emily six months.
Derek became consistent.
Every Tuesday and Thursday evening.
Alternate weekends later.
He attended pediatric appointments.
Never missed one after first three months.
He stopped calling himself victim.
That mattered.
Then during one exchange he said:
“I told my therapist I thought paying for things meant I was providing.”
I waited.
“He said providing without care is just accounting.”
Maybe simplistic.
Still.
Then:
“I’m sorry I made you carry yourself to the hospital.”
I looked at Emily.
“You didn’t.”
“What?”
“Rachel did.”
He almost smiled.
Then serious:
“I’m sorry.”
I believed.
Not enough to restore marriage.
But enough to co-parent.
Then Patricia became grandmother we both trusted.
She stayed out of conflict.
No reporting.
No manipulation.
Then Michael Cole.
He sent annual medical update through attorney for Emily.
No contact requested.
We planned to tell Emily age-appropriately later that she was donor-conceived through a serious consent failure but still born wanted by me.
How to frame Derek?
He was legal/intentional father despite deception.
Complex.
Therapist.
No shame.
Then a new issue.
Genetic screening showed Emily carried a rare connective-tissue marker Michael did not have.
I had? No.
Maybe lab variance.
We tested me.
No.
Then Michael.
No.
How could Emily carry variant from neither?
De novo mutation possible.
Yes.
Geneticist said could arise spontaneously.
But another marker set raised concern.
Her DNA did not match Michael at expected paternal confidence?
Wait prior paternity test said Michael? We had assumed based records, but did we ever test Michael directly? We tested Derek only. Right! We had not done Michael paternity DNA, only clinic said donor. Important.
Michael agreed.
DNA:
0% paternity.
Everything shifted again.
So Northstar records saying Michael sample were wrong too.
Who was biological father?
Not Derek.
Not Michael.
Then clinic thaw logs.
Sample actually used:
Code ALM-1989.
Allen Mitchell?
ALM.
Could be.
My body went cold.
We tested Allen.
Probability of paternity:
99.99%.
No.
Emily’s biological father was Derek’s father.
The backup had not been backup.
It had been the actual sample used.
That made Emily genetically Derek’s half-sister.
Legally his daughter.
Emotionally his daughter.
Biology added another layer.
Derek vomited after hearing.
Allen cried.
“I did not consent.”
None of us had.
Then why clinic record initially showed Michael?
Someone changed.
Dr. Lane?
He admitted.
After transfer, he realized Allen’s sample was used mistakenly—or intentionally? Let's see.
Derek had given instruction:
Use Michael first. Allen backup.
Lab tech mislabeled vials? Could be.
Dr. Lane discovered after pregnancy.
Told Derek.
Did Derek know all pregnancy?
Yes.
He knew Allen was biological source.
He never told me.
Another massive lie.
He had carried it nine months.
Then paternity test after birth he acted shocked Derek not father.
But he knew. His reaction could be because he feared reveal. He accused me falsely to cover.
This destroys progress and earlier apology. But maybe he later confessed? We need handle. Did he know definitely? Dr. Lane email.
DEREK:
Do not tell Anna. It changes nothing.
LANE:
She must be informed.
DEREK:
After delivery.
Again after.
Dr. Lane failed.
So Derek’s later change had still hidden biggest truth.
I confronted.
“You watched me investigate Michael.”
“I was ashamed.”
“You let Michael think his sample was stolen.”
“I thought Lane’s record would protect everyone.”
“Protect?”
He meant Allen.
Himself.
Not me.
Then I said:
“You have not changed. You’ve only gotten better at apologizing for the lies already discovered.”
That ended co-parenting trust.
Not parental rights automatically.
But communications tightened.
Therapeutic intervention.
Then Derek made one choice.
He voluntarily disclosed everything to court and fertility investigation.
No more concealment.
He wrote a sworn statement admitting knowledge.
That exposed himself civilly.
Maybe finally accountability.
Then Allen.
He wanted no paternal role.
He was Emily’s biological grandfather and biological father simultaneously in genetic terms. Family relation complicated.
We agreed socially he remained Grandpa Allen? But he had been estranged. Emily didn't know him. Better no role until later.
Then genetic counselor helped.
Derek remained Daddy legally and socially.
Biology explained age-appropriately later.
No shame.
Then something from Allen.
He sent old medical-storage agreement.
A handwritten note from Dr. Lane dated seventeen years earlier:
Sample reserved per Patricia Mitchell request.
Patricia.
Derek’s mother.
Why was she involved in preserving Allen’s sperm after divorce?
She had told us she forgot it existed.
Apparently she had personally requested preservation.
I called her.
May you like
She went silent.
And the next family secret opened.
