Chapter 3 - DEREK HAD BEEN PREPARING FOR A CUSTODY FIGHT BEFORE I LEFT

I read the affidavit at 2:07 in the morning.

Then I read it again.

The language was too polished to be spontaneous.

Examples:

Anna became increasingly emotional after pregnancy.

Anna relies heavily on her sister Rachel, who encourages conflict.

Anna has expressed dissatisfaction with Columbus and interest in relocating.

Anna has reduced her commitment to work.

Every sentence contained something technically connected to reality.

I cried when pregnant.

Rachel disliked Derek.

I once said Pittsburgh felt more like home.

I took maternity leave.

But arranged together, the facts became a portrait of a woman preparing to disappear with a child.

That was not what happened.

Until he threw fifteen dollars onto the counter.

Then I actually left.

Had he expected it?

Maybe.

Was the cruelty deliberate?

That thought frightened me.

Did he want me to leave so he could use it?

Cynthia cautioned me.

“Don’t assume motive from draft language. We need who prepared it and why.”

Good.

The metadata named:

Harper & Lowe Family Counsel.

Derek had consulted a divorce attorney four months earlier.

I had no idea.

Why?

Maybe he had been planning to leave me too.

Then another email from Kevin:

If you are serious about separation, move only legitimate business funds. Don’t do anything that looks like hiding marital property.

So Kevin had warned him.

Important.

Derek ignored partly.

Then:

Have you told Anna about the LLC?

Derek:

No.

Kevin:

You need to.

Derek:

After the baby.

Always after.

Then he consulted attorney.

Questions:

Could he claim primary custody if Anna relocated?

Could he stop breastfeeding mother from taking newborn out of state?

Could he keep house?

Could he protect business income?

Could he argue hidden accounts were separate?

He was preparing.

Why?

Then one message to his mother, Patricia.

I had barely thought about her because she lived in Cincinnati and usually stayed out of our marriage.

DEREK:

Anna is becoming difficult.

PATRICIA:

Pregnancy is hard.

DEREK:

Rachel is poisoning her.

PATRICIA:

Then stop complaining to me and support your wife.

That surprised me.

Another:

DEREK:

If she leaves, I may need you to testify.

PATRICIA:

To what? I’m not lying for you.

I stared.

His mother knew something was wrong.

Then another:

PATRICIA:

Did you tell her about the consulting business yet?

My stomach dropped.

Patricia knew.

Derek:

No.

PATRICIA:

Then don’t call her dishonest if she gets angry when she finds out.

She had warned him.

Why never tell me?

Maybe because she thought it was his responsibility.

Then after Emily was born, Patricia called.

I finally answered.

Her first words:

“Are you and the baby safe?”

I almost cried.

“Yes.”

“Good.”

Then:

“Derek told me you disappeared.”

“He gave me fifteen dollars and went to dinner.”

Silence.

Then Patricia said:

“He told me you refused to let him drive you.”

Of course.

“He lied.”

“I believe you.”

That surprised me.

Then she said:

“There’s something I should have told you months ago.”

My body went cold again.

“What?”

“Derek lost his real job two weeks ago.”

I sat up.

“What?”

He had not been going to work?

He still dressed every morning.

Laptop.

Calls.

Client dinner.

Patricia explained:

His employer terminated him after internal review into conflict-of-interest concerns involving his consulting LLC.

He had been diverting clients?

Maybe not outright.

But consulting with vendors who also did business with employer.

Disclosure violations.

He was fired.

Then why client dinner on labor night?

Not employer.

His private consulting client.

He chose business over me while unemployed from his main job.

I felt nauseated.

Then Patricia continued:

“He told me he hadn’t told you because he wanted to fix it before the baby came.”

“Did he get severance?”

“Yes.”

How much?

Around $140,000.

Where?

Likely secret account.

That explained part of $146k.

So not all hidden profit.

Then Cynthia advised file soon.

We filed for divorce and temporary orders in Franklin County.

Not Pittsburgh.

I could stay temporarily near sister while legal counsel handled residence issues, but I needed carefully address jurisdiction/custody. Emily’s “home state” under UCCJEA as newborn could be complicated based where she was born and parents lived. Cynthia handled. I did not pretend Facebook law.

Derek filed next morning.

He asked court to order Emily returned to Columbus immediately.

He alleged I absconded during labor.

Then his affidavit included:

I offered Anna transportation to Riverside Methodist Hospital. She refused.

False.

What evidence?

None yet.

Then I remembered kitchen camera.

Derek had installed a small security camera above pantry after package theft.

Did it record interior audio?

Maybe.

I accessed our shared smart-home cloud account.

Password still worked.

Video from the kitchen.

There I was.

Hand on back.

Hospital bag.

“I told you contractions are five minutes apart.”

Derek:

“And I told you I have a client dinner.”

Then wallet.

Ten.

Five.

“Taxi money.”

Then:

“You know where Riverside is.”

Clear.

I downloaded immediately.

Then my wedding ring beside money.

Then me leaving.

No screaming.

No threat.

No refusal of offered ride.

Evidence.

Cynthia smiled when she saw.

“Keep original metadata.”

Good.

Then another clip from four nights earlier.

Derek speaking on phone after I went upstairs.

“I think she’s going to bolt after the baby.”

Pause.

“No, don’t stop her.”

My skin went cold.

“Let her go. It’s cleaner if she leaves first.”

Who was he speaking to?

Audio did not capture other side.

Then:

“I need her to be the one who abandons the house.”

There.

He may have wanted me gone.

Then final:

“After that, we can discuss the baby.”

We?

Who?

I checked call logs later through discovery.

Number belonged to:

Vanessa Cole.

I knew that name.

Derek’s largest private consulting client.

And according to property records, Vanessa owned the commercial building where Buckeye Medical Property Partners operated.

The business partner tied to his hidden wealth was a woman he called the night he decided it would be “cleaner” if his pregnant wife left first.
